Terms & Conditions

1. Agreement

These Terms & Conditions (“Terms”) govern your use of the PharmaNex website and platform. By accessing or using PharmaNex, you agree to these Terms.

2. Who can use PharmaNex

You must be 18+ and legally able to enter into agreements to use our services. If you use the service on behalf of an organisation (e.g., a pharmacy), you confirm you have authority to act.

3. Services provided

PharmaNex is a platform that connects patients with licensed pharmacies and delivery providers. We facilitate ordering, prescription handling, and delivery logistics. We do not dispense medication ourselves; partner pharmacies fulfil and dispatch orders.

4. Accounts & security

You are responsible for keeping your account credentials secure. Notify us immediately if you suspect unauthorised access. We may suspend accounts for suspected misuse.

5. Orders, payments & fees

  • Prices, delivery fees, and commissions are displayed at checkout. Payments are processed via third-party providers; we are not responsible for payment processing failures.

  • Refunds and cancellations are governed by the pharmacy’s and courier’s policies; PharmaNex will assist in mediation where appropriate.

6. Prescriptions & medical information

  • You must provide accurate prescription information. Pharmacies may validate prescriptions before fulfilment.

  • PharmaNex is not a substitute for professional medical advice. Always follow your healthcare provider’s instructions.

7. Delivery

  • Delivery times are estimates. Delays can occur due to stock shortages, traffic, or third-party issues. We aim to keep you informed via tracking updates.

  • Proof of delivery may be captured (signature, photo, or OTP).

8. User conduct

You must not misuse the platform (e.g., submit false prescriptions, engage in fraud, harass staff or couriers). Violations may result in account termination and legal action.

9. Intellectual property

All content on PharmaNex (text, graphics, trademarks, logos) is owned by PharmaNex or licensed to us. You may not use our intellectual property without permission.

10. Liability & disclaimers

  • To the fullest extent permitted by law, PharmaNex is not liable for indirect, incidental, or consequential damages arising from use of the service.

  • We use reasonable care to select licensed pharmacy partners, but we do not warrant product availability or medical suitability. Any clinical questions should be addressed to a qualified professional.

11. Privacy & data

Your use of PharmaNex is also governed by our Privacy Policy. By using the service you consent to that policy.

12. Termination

We may suspend or terminate access for breach of these Terms or for operational reasons. You may close your account at any time.

13. Changes to Terms

  • We may update these Terms. Material changes will be notified via the app or email. Continued use after changes indicates acceptance.

14. Governing law & disputes

These Terms are governed by the laws of the Republic of South Africa. Disputes will be handled in South African courts unless otherwise agreed.
